Short answer

The IRS penalty for a late or incorrect 1099, W-2 or 1095 is $60 per form if corrected within 30 days of the due date, $130 per form if corrected by August 1, and $340 per form after that or if never filed. These amounts apply to returns due in both 2026 and 2027. Late recipient copies are penalized separately at the same rates, so one form can cost twice. Each tier has an annual cap (lower for businesses with $5 million or less in gross receipts), except for intentional disregard: at least $690 per form for 2027 with no cap.

  • 2027 small-business caps: $244,500 / $698,500 / $1,397,000
  • 2027 large-business caps: $698,500 / $2,095,500 / $4,191,500
  • De minimis safe harbor: errors up to $100 ($25 for withholding)
  • Respond to Notice 972CG within 45 days

Information return penalty amounts

These apply per form to 1099s, W-2s, 1095s and other information returns, under sections 6721 (filing with the IRS) and 6722 (furnishing recipient copies) of the tax code. The IRS adjusts them for inflation each year: the amounts for returns due in 2027 are in Rev. Proc. 2025-32 and those due in 2026 in Rev. Proc. 2024-40, and the IRS information return penalties page lists them all.

Intentional disregard is the greater of the minimum above or 10% of the amounts that should have been reported (5% for some broker returns). 2026 small-business caps: $239,000, $683,000 and $1,366,000.

How the penalties work, in plain English

You can be penalized twice for one form

Filing with the IRS and giving the recipient their copy are separate duties, with separate penalties. A 1099-NEC that's late to both costs twice the per-form amount.

The clock rewards fixing things fast

The penalty drops to the lowest tier if you file, or correct, within 30 days of the due date. Waiting past August 1 makes it more than five times as much. If you've missed the deadline, file as soon as you can. Don't wait to batch everything.

"Late" includes "wrong"

A form filed on time but with a missing or incorrect TIN, wrong amounts, or on paper when you had to e-file, can be penalized like a late one until it's corrected. That's why TINs matter: see our TIN checker and B notice guide.

Small mistakes get some slack

Under the de minimis safe harbor (explained in Publication 1099), a dollar amount that's off by $100 or less ($25 or less for withholding) generally doesn't need correcting. There's also an exception for a small number of errors corrected by August 1.

Reasonable cause can wipe it out

If something outside your control caused the problem and you acted responsibly, the IRS can waive the penalty. Following the W-9 and B notice rules counts (see Publication 1586). If you get a proposed penalty notice (Notice 972CG), respond within 45 days (60 days for foreign filers).

Avoiding penalties next year

  1. Collect a W-9 from every payee before the first payment (try our W-9 request generator).
  2. Work out who needs a form early with Do I need to file a 1099?
  3. Put the dates on your calendar from our filing deadlines page. 1099-NEC and W-2 are due January 31.
  4. E-file. It's required at 10 or more returns, and you get a confirmation that the IRS accepted each form.

Questions

Penalty questions

What is the penalty for filing a 1099 late?

For returns due in 2027 (tax year 2026), it's $60 per form if you file up to 30 days late, $130 per form if you file 31 days late through August 1, and $340 per form if you file after August 1 or don't file, the same as for returns due in 2026. Intentional disregard is at least $690 per form ($680 for 2026), or 10% of the amounts that should have been reported if that's more, with no cap. The same amounts apply separately to recipient copies furnished late, so one late form can be penalized twice.

Is there a maximum 1099 penalty?

Yes, except for intentional disregard. Each tier has an annual cap, which is lower for small businesses (average annual gross receipts of $5 million or less over the past three years). For returns due in 2027, the small-business caps are $244,500, $698,500 and $1,397,000 for the three tiers ($239,000, $683,000 and $1,366,000 for 2026).

Do the same penalties apply to W-2s and 1095s?

Yes. Late or incorrect Forms W-2, 1095-B and 1095-C fall under the same information return penalty rules and amounts as 1099s.

Are there penalties for wrong information, not just late filing?

Yes. Filing a return with a missing or incorrect TIN, wrong amounts, or on paper when you were required to e-file can be penalized at the same per-form rates. Correcting it quickly puts you in a lower tier.

Can I get a 1099 penalty removed?

Often, if you had reasonable cause and acted responsibly: for example, you collected a W-9, followed the B notice rules and corrected errors promptly. Respond to the IRS's proposed penalty notice (Notice 972CG) within 45 days (60 days for foreign filers) with your explanation.

What if the error is only a few dollars?

There's a de minimis safe harbor: if a dollar amount is wrong by no more than $100 ($25 for tax withheld), you generally don't have to correct it and no penalty applies, unless the payee asks for a corrected form.
