1099s and rent: who reports what

Businesses that pay rent, property managers who collect it, and landlords who pay contractors all have 1099 duties. Pick your role to see yours.

Runs entirely in your browser. Nothing you select is sent to us or stored.

Short answer

A business that pays rent for office space, equipment or land reports it on Form 1099-MISC, box 1, once the year's total to a non-corporate landlord reaches $2,000 for rent paid in 2026 ($600 in 2025). Rent paid through a real estate agent or property manager isn't reported by the tenant: the agent reports the rent passed on to the owner. Landlords whose rental is a trade or business report payments for services to unincorporated contractors on Form 1099-NEC. Rent paid by card or payment app is reported on Form 1099-K instead.

  • Rent paid for your own home isn't reported
  • Machine rental with an operator: machine in 1099-MISC box 1, operator in 1099-NEC box 1a
  • Rent to corporations is generally not reported
  • Materials and goods aren't reported, only services

The rules by role

Businesses paying rent

1099-MISC, box 1

  1. Total the rent you paid each landlord for the year: offices, shops, warehouses, equipment, machinery, land.
  2. If the total reaches the threshold ($600 for rent paid in 2025, $2,000 for rent paid in 2026 and later) and the landlord isn't a corporation, file a 1099-MISC with the rent in box 1.
  3. Don't report rent you paid to a real estate agent or property manager. They report it to the owner.
  4. Leave out rent paid by credit card or a payment app; that's on the processor's 1099-K.

Get a W-9 from every landlord. It tells you whether they're a corporation and gives you the TIN you need.

Property managers and real estate agents

1099-MISC to owners, 1099-NEC to contractors

  1. For each property owner, total the rent you collected and paid over to them during the year, and report it on a 1099-MISC, box 1, once it reaches the threshold.
  2. Report payments you made to contractors on the owners' behalf (repairs, cleaning, landscaping) on 1099-NEC, the same as any business.
  3. Collect W-9s from owners and contractors when you take them on, not in January.

Landlords paying contractors

1099-NEC, if renting is your business

  1. If your rental activity is a trade or business, payments for services (repairs, maintenance, property management fees) to unincorporated contractors are reported on 1099-NEC once a contractor reaches the threshold.
  2. Whether a rental counts as a business depends on the facts, such as how many properties and how actively you manage them. If you're not sure, ask a tax professional.
  3. Payments for materials and goods aren't reported, only services.

Tenants renting a home

No 1099

  1. Rent for your own home is a personal payment, so you don't file a 1099 for it.
  2. If you run a business from home and deduct part of the rent, that still isn't a reportable payment on a 1099 in most cases. Check with a tax professional if you're unsure.

Equipment rented with an operator

If you rent a machine and its operator together, such as a bulldozer with a driver, split the payment: the rent for the machine goes in box 1 of Form 1099-MISC and the operator's charge in box 1a of Form 1099-NEC.

Questions

Rent and 1099 questions

Do I need to send my landlord a 1099?

If your business paid rent for office space, a warehouse, equipment or land, and the landlord isn't a corporation, generally yes: Form 1099-MISC, box 1, once the year's rent reaches the threshold ($600 for rent paid in 2025, $2,000 for rent paid in 2026 and later). Don't send one if you paid rent through a real estate agent or property manager; they report it to the owner instead. Rent you pay for your own home isn't reported.

Does a landlord have to send 1099s to contractors?

If renting out property is a trade or business for you, payments you make for that business, like a plumber, painter or property manager's services, are reported like any other business: 1099-NEC to unincorporated contractors you paid at least the threshold. Whether a small rental counts as a business depends on the facts; many landlords simply file to be safe.

Do property managers file 1099s for owners?

Yes. A property manager or real estate agent who collects rent on behalf of an owner reports the rent paid over to the owner on Form 1099-MISC, box 1, once it reaches the threshold. They also report payments they make to contractors on the owner's behalf.

Is rent paid to a corporation reported?

Generally no. Payments to C and S corporations, including LLCs taxed as corporations, are usually exempt. The landlord's W-9 tells you their tax classification.

What about rent paid by credit card?

Card and payment-app payments are reported by the processor on Form 1099-K, so leave them off your 1099-MISC.

Is anything I select here sent to EFileForMe?

No. The picker runs in your browser and nothing is sent or saved.
